By accessing or using Initech's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.
These Terms constitute a legally binding agreement between you and Initech regarding your use of the Services. You represent that you are at least 18 years of age and have the legal authority to enter into this agreement.
Services
Initech provides cloud infrastructure services including but not limited to:
- Virtual Private Server (VPS) provisioning
- Multi-cloud deployment across various providers
- Server management and monitoring tools
- Technical support services
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.
Account Terms
You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Ensuring your email address remains valid and accessible
- Notifying us immediately of any unauthorized access
You may not share, sell, or transfer your account to another party without our prior written consent.
Payment & Billing
Accepted Payment Methods
We accept the following payment methods:
- Cryptocurrency (Bitcoin, Ethereum, Monero, and 20+ others)
- Account credit/balance
Billing Cycle
Services are billed in advance on a recurring basis (monthly, quarterly, or annually depending on your selected plan). You agree to pay all fees associated with your selected services.
Refunds
Due to the nature of our services and the inability to reverse cryptocurrency transactions, all payments are final. Refunds may be issued at our sole discretion in the form of account credit.
Acceptable Use Policy
You agree to use the Services only for lawful purposes and in accordance with these Terms. You are solely responsible for all data, content, and activities conducted through your account.
You must comply with all applicable local, state, national, and international laws and regulations regarding your use of the Services.
Prohibited Activities
The following activities are strictly prohibited:
- Child sexual abuse material (CSAM) or exploitation
- Human trafficking or exploitation
- Terrorism or violent extremism
- DDoS attacks or network abuse targeting third parties
- Sending unsolicited bulk email (spam)
- Cryptocurrency mining without explicit permission
- Distribution of malware or ransomware
- Fraudulent activities or scams
- Violation of intellectual property rights
- Any activity that violates applicable law
Termination
Termination by You
You may terminate your account at any time by contacting support or through the client area. Upon termination, you remain responsible for any outstanding charges.
Termination by Us
We reserve the right to suspend or terminate your account immediately, without prior notice, for:
- Violation of these Terms or the Acceptable Use Policy
- Engaging in prohibited activities
- Non-payment of fees
- At our sole discretion for any reason
Upon termination, all data associated with your account may be permanently deleted.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INITECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
Our total liability for any claims arising from or related to the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Initech and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:
- Your access to or use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you transmit through the Services
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date.
Your continued use of the Services after any changes constitutes acceptance of the modified Terms.
